2 Application of the terms and conditions

The acceptance of the terms and conditions of sale implies the enforcement of these conditions. They apply to all orders placed by the customer on the site RUBBERSOLE. They involve a contract between RUBBERSOLE and the customer. The customer shall not oppose RUBBERSOLE with any contradictory documents.

These general conditions of sale may be subject to amendment, the version that applies to the customer order is the version that is on the website on the date that the customer places their order. Changes to these terms of sale are binding for customers purchasing after they are posted on RUBBERSOLE and cannot be applied retrospectively to transactions previous to this date.

All site users must respect the general conditions of sale.

3 Validity of our offers

Our offers are intended solely for consumers with a delivery address within the United Kingdom. Our delivery service does not include the Channel Islands, BFPO and PO Box addresses.

The items displayed on the site are available until depletion of stocks.

RUBBERSOLE shall send an email to any Customer who has placed an order for an item which is unavailable. In the event of debit or payment of an order for an item which is unavailable, RUBBERSOLE shall offer the Customer a credit note or refund within 15 days. The order is automatically canceleld.

4 Presentation of products

All products for sale are described and presented as accurately as possible. The Customer is obliged to refer to the description of each product in order to know their details and the essential characteristics. The Customer is obliged to take knowledge of it before any order is placed. The choice and purchase of a Product is the sole responsibility of the Customer.

However,RUBBERSOLE cannot be held responsible for any errors or omissions which may occur in this presentation. All customers are invited to inform RUBBERSOLE of any error in product descriptions they may notice.

5 Customer account creation

To place an order, the customer must first have created a customer account, at the time of his first order. He / she must fill in a form containing the following information: e-mail address, title, surname, first name, sex, date of birth, full delivery address, telephone number. On this occasion, the Customer creates a password that is personal and for its unique use. Any disclosure to third parties is prohibited.

The customer must provide complete and accurate information. Any impersonation, identity theft or false information could lead to the closure of a customer account and may result in prosecution. Multiple inscriptions, use of a customer account by multiple people or other fradulent activity may result in termation of the customer registration.

The Customer acknowledges having the capacity required to contract and acquire the products offered on the RUBBERSOLE website.
RUBBERSOLE refuses any sale to minors under 16 years of age without the prior authorization of the parents which will be systematically required.

6 Price of products

All prices are listed in Pounds Sterling (£GBP) inclusive of VAT for the United Kingdom. The VAT amount is indicated when the customer selects a product. RUBBERSOLE reserves it's right to change prices if there is a change in the VAT rate. These changes may be passed on in the price of the items without previously informing the customer.

Prices take into account possible reductions that would be granted on the site. These prices are firm and not revisable during their period of validity, as indicated on the site. RUBBERSOLE.CO.UK reserves the right, outside this period of validity, to modify the prices at any time. Prices do not include the costs of processing, shipping, transport and delivery which may be charged extra, if so specified on the site. The payment requested from the Customer corresponds to the total amount of the purchase, including these costs.

An invoice is issued by RUBBERSOLE.CO.UK. The invoice is available to be downloaded from the website once the order has been despatched.


7 Ordering and Secure Payment

7.1 : Order

Those residing in the Channel Islands or having a BFPO or PO Box address can not place orders on the RUBBERSOLE website.
The customer validates his order as described below. This validation implies the acceptance of these general conditions of sale of RUBBERSOLE. The customer interested in an item visible on the RUBBERSOLE website follows the following process in order to establish his order.
- Choose size and color
- In the shopping cart, check the specificities of the order (color, quantity, size, price, etc ...) with possibility of modification, addition or even deletion of certain items.
- At the time of its first order, fill in an account creation form with a password.
- If the Client receives a special offer, first enter the code assigned to him in the field provided for this purpose.
- Choose the method of payment, type of delivery and delivery address.
- After having validated the method of payment, definitively and irrevocably validate the order with the effects indicated below. Any validated order results in a payment obligation.
- An email of confirmation of your order is sent as final sale proof after the receipt of the full amount (which is not a deposit payment). The Products are reserved for 7 days.

The transfer of ownership of the products sold by RUBBERSOLE in favor of the Customer, will occur only after full and proper payment by the latter, and this whatever the delivery date of the products. The retention of title clause does not prevent the risk of loss or deterioration of the goods to be borne by the Customer as soon as it is delivered at home or withdrawn in relay.

It is the Customer's responsibility to verify the accuracy of the order and to report any errors immediately.


7.2 : Payment

Payment by credit or debit card
The Customer shall provide the number of his / her bank card associated with the expiry date and the security code.
Finally, he validates his order by clicking on the "Confirm" button. In order to secure the payment, in some cases confirmation of the payment is made only after entering a 3D-Secure code provided by the bank. By checking the Remember box, the Customer agrees that the credit card number associated with the expiry date will be retained for future purchases.

Paypal
To any holder of a PayPal account, the payment is done online, by this account, simply stating the email address and PayPal password.
Thus, the Client's financial information is never communicated to RUBBERSOLE. PayPal encrypts and protects the card number once and for all.

Payment by Gift Card
Payment by gift card is possible. Customer will inform in Coupon section the gift card number. If the amount of the order is greater than the amount of the gift card, the Customer will have to complete the payment by another means of payment. If the amount of the order is less than the amount of the gift card, the Customer may use the balance for a next order within the period of validity of the gift card.


7.3 : Non-payment

RUBBERSOLE reserves the right to refuse to make a delivery or to honor an order emanating from the Customer who has not totally or partially settled a previous order or with which a payment dispute is in the course of administration or if Presents a risk of fraud.

Any rejection of credit card, any rejection of payment, any abusive dispute with Paypal may give rise to a recovery procedure by the company RUBBERSOLE. For all recoveries of arrears, RUBBERSOLE will apply penalties and, in addition, collection costs may be payable.



7.4 : Payment Verification

RUBBERSOLE checks all orders that have been validated on its site. These controls aim to protect RUBBERSOLE from abusive practices: identity theft, payment fraud. The services of RUBBERSOLE will be required to ask any Customer, all the parts necessary to unblock the order: proof of address and identity of the customer, etc ...

If these parts are not received within 7 days, the order will automatically be canceled.

Any receipt of non-compliant documents will also result in the cancellation of the order.



7.5 : Security of payments

In order to ensure security of payments, the RUBBERSOLE website uses a secure payment service. This service integrates the SSL security standard. The confidential data (the 16-digit bank card number, the expiry date and the security code) are directly transmitted encrypted on the server of the bank without passing on the physical media of the RUBBERSOLE servers. When the order is validated, the payment request is routed in real time to the secure payment manager. The latter sends an authorization request to the bank card network. The telepayment manager issues an electronic certificate which will be proof of the amount and date of the transaction.

8 Identification

The Customer who has already made a purchase on the RUBBERSOLE website can choose a password allowing him / her, in subsequent orders, not to have to fill out the forms before the order is placed.
The Customer already registered is recognized on the site as being a customer of RUBBERSOLE. The password for the RUBBERSOLE customer is strictly confidential and personal. Under no circumstances should it be disclosed or communicated to anyone.

If the password is forgotten, the RUBBERSOLE.CO.UK Customer can click on the link «Forgot your password? Click here", on the identification page. On the following page, the Customer will have to enter their email address and click on «Send». Customer will then receive a link in his mailbox allowing him to reset the password. This new password will automatically replace the old one.
To order again, the RUBBERSOLE.CO.UK Customer must log in by entering their username and new password in the space dedicated for this purpose. This password is not used in any way to make any payment.

9 Delivery operated by RUBBERSOLE.CO.UK

At this time we are unable to deliver any orders to the Channel Islands, the Isle of Man, BFPO addresses or PO Box addresses.
The delivery times indicated are based on the order date and are presented in working days (Saturday, Sunday and public holidays are not taken into account in the calculation of the delivery time). In case of force majeure, RUBBERSOLE can not be responsible for the delayed delivery.
RUBBERSOLE offers several delivery methods which are automatically selected according to the products put in the basket. They are visible on the payment page.
In the same order with several products, the customer can have 2 different delivery methods and he will receive 2 separate packages according to delivery.

10 Money-back guarantee

All items purchased on RUBBERSOLE site may be a return to "Money-back guarantee" if the client will not maintain a product for legitimate reasons: the product does not appeal, has not the right size, not the expected color, etc .... RUBBERSOLE products may be exchanged or refunded for the amount paid (free return see 10.1).

To be accepted, returns must meet the following specifications:

- The product(s) must never have been worn outdoors. The product(s) is (are) to be in new condition,
- The returned product(s) must correspond to the product(s) delivered,
- The product(s) is (are) returned in its (their) original packaging in good condition (shoe box not taped), all in a package properly closed,
- The product(s) is (are) returned within 30 days of receipt of the order,
- Empty packaging will be refused for any exchange or refund,
- Customers must follow the procedure below.

Any customer may exercise a right of withdrawal according to the European Directive 2011/83 / EU for all items purchased on the RUBBERSOLE website. It must do so within 14 days of receipt of the order by the client himself or by a third party he has mandated. The customer can then be reimbursed, as soon as all the products of the order are returned in new condition, in their original packaging (a check will be systematically carried out), including delivery costs (except for Additional costs arising from the customer choosing a delivery method other than RUBBERSOLE's least expensive standard delivery option). The return costs are the responsibility of the customer. Such return shall be made without undue delay and in any event not later than 14 days from the receipt of the withdrawal form.


10.1: The means to make a return are as follows:

- Free return by Collect +. All other return methods will be at the customer's expense.


10.2: The return procedure is as follows:

Sign in to your RUBBERSOLE account with your email address and password and go to the "My Returns" section to complete the return request form.

Step 2: Get the label
You will receive an email with a link to print your pre-paid return shipping label.

Step 3: Deposit the package to the Collect+ shop
Take the parcel to your neareast Collect + drop off point.
Keep proof of posting of the parcel for any subsequent dispute.
The return is processed within 7 to 10 working days.

11 Process Regarding Parcels Not Delivered by Our Transport Provider

11.1: Returns for UNKNOWN ADDRESS:

These are the packages returned by the provider responsible for delivery under the heading: address unknown. After receipt and acceptance of the package by RUBBERSOLE, he will contact the customer to return his order if the product is still available or to proceed with the refund of the order according to the wish of the customer.
RUBBERSOLE reserves the right to proceed with the refund of the order and not to the return of the order in case several returns due to "UNKNOWN ADDRESS" are identified.


11.2: Returns for "UNCLAIMED PARCEL":

These are parcels that have not been claimed by the customer at the post office, or at the Relay within the specified time. After receipt and acceptance of the package by RUBBERSOLE, he will contact the customer to return his order if the product is still available or to proceed with the refund of the order according to the wish of the customer. RUBBERSOLE reserves the right to refund the order and not to the return of the order in case several returns due to "UNCLAIMED PARCEL" are identified.


11.3: Returns for "REFUSED PARCEL":

This is the package that the customer refused delivery. After reception and acceptance of the parcel by RUBBERSOLE, a voucher will be credited to his customer account within 72 hours of receipt of the parcel. The customer can request the cancellation of his voucher and his refund directly on the "CUSTOMER SERVICE" area of the RUBBERSOLE website.

RUBBERSOLE does not guarantee the reservation of the items ordered and may be obliged to process the refund of the order if the return of a package follows the causes "UNKNOWN ADDRESS", "UNCLAIMED PARCEL", or "REFUSED PARCEL" if Products are not available.

12 Responsability

For all the stages of access to the site, consultation, filling of forms, ordering, delivery of items or any other service, the company RUBBERSOLE has only an obligation of means. Consequently, RUBBERSOLE can not be held liable for any inconvenience or damage inherent in the use of the Internet network and totally outside the diligence and precautions taken by RUBBERSOLE. In particular, any disruption in the provision of the service, or any external intrusion or presence of computer virus, can not engage the responsibility of RUBBERSOLE. Similarly, any other incident of force majeure under the jurisprudence of the Supreme Court exonerates RUBBERSOLE from liability. Customers benefit from the guarantees granted by the brands on the site.

13 Intellectual Property

All elements of the RUBBERSOLE website, whether visual or sound, including the underlying technology, are protected by copyright, trademarks or patents.
They are the exclusive property of SPARTOO UK.
Any hyperlink referring to the site of RUBBERSOLE and using in particular the technique of framing, deep-linking, in-line linking or any other technique of deep link is in any case formally prohibited.
In all cases, any link, even tacitly authorized, will have to be withdrawn upon request of RUBBERSOLE.

14 Protection of Personal Data

14.1: Collection of personal data

When creating the Client's account and when ordering the Customer on the RUBBERSOLE website, SPARTOO UK collects personal data. This collection is adequate, relevant and limited only to what is necessary to specified purposes for which they are processed. The person responsible for collecting the data is SPARTOO UK Limited, registered under number 05221282, whose registered office is located at 180-187 Kings Cross Road, London WC1X 9DE - United Kingdom. SPARTOO UK Ltd has declared to the ICO (Information Commissioners' Office) the protection of the Customer's personal data and its fight against fraud: registration number: ZA226864.

The term "personal data" shall mean all data which identify an individual, such as the surname, first name, telephone number, date of birth, gender, e-mail address, postal address, IP address and any information the Customer will choose to communicate RUBBERSOLE about it.

For the purposes of combating fraud as set out below (points 2 and 3), RUBBERSOLE is also likely to retain information, for a limited period (point 5), on transactions carried out on its sites, including a truncated part of the bank card numbers used to carry out the said transactions and Their date of expiry.


14.2: Purpose of data collection

Personal data shall be collected, only for specified, explicit and legitimate purposes, to fulfill one or more of the following purposes:

The company SPARTOO UK may then have to transfer the data to foreign companies. It undertakes to communicate this data only to foreign companies with the same level of data protection as Great Britain and the European Community.


14.4: Retention of personal data

The collected data are kept for a period of five years from the last transaction carried out on the site or from the last update of the customer account.
Some of your bank data, which are truncated credit card numbers and their expiry dat, are kept for a period of 13 month from the last transaction or last update for the purpose of combating fraud. In the event of an explicit agreement by the Customer who has checked the "Remember" box, RUBBERSOLE is authorized to keep these bank data in order to simplify future regulations. These data are retained for a period of thirteen months from the last transaction or last update. The security code is systematically destroyed after an effective, complete and undisputed transaction.
In the absence of a new transaction or update of the Client account during the five-year period, the Customer data is automatically deleted.


14.5: Cookies

RUBBERSOLE measures the number of page views, the number of visits and visitor activity on the site and their frequency of return using the use of "cookie" technology.
A cookie does not identify the Customer. It records information relating to the navigation of the Customer's computer on the RUBBERSOLE website (the pages consulted, the date and time of the consultation, etc.) and to be able to read them during subsequent visits.

14.7: Reciprocity

The Customer agrees to respect, during any data collection or communication of data from RUBBERSOLE not to disclose them and to keep them only for his personal use. RUBBERSOLE reserves the right to refuse to communicate the data to it, such as asking the Customer to delete them.

15 Games and Competitions

All competitions are subject to a regulation available on the website. The online contests of RUBBERSOLE are free and can be with or without a purchase obligation. They are open to any person residing in the country concerned by the competition which will have registered to participate and who will have read and accepted the rules of the game. The duration of the competition and the modalities of participation are defined in the rules. The winners of the Games are notified by email. RUBBERSOLE reserves the right to suspend, postpone or cancel a Competition and can not be held responsible for any problem that may arise during the duration of the operation.
Claims, refunds and other terms and conditions are defined in the contest rules. Any fraud or attempted of fraud committed with a view to improperly collecting a gain may result in prosecution.

16 Private Sales

The products presented in "RUBBERSOLE private sales" are available to all those who meet at least two of the following conditions:
- They are a customer at RUBBERSOLE having opened an account on the site with a valid email address and password
- They have received an invitation by email sent to the account address
- They have received at least one email from RUBBERSOLE

17 Gift cards and money-off vouchers

Gift cards or coupons are in the form of discount coupons with a unique code. Gift cards and money-off vouchers are non-refundable and have no monetary value. However, products purchased using vouchers and coupons may be returned for an exchange, or a credit note if the items are no longer in stock or non convenient.The gift card or voucher will be re-credited and must be used during their period of validity.
They are not combinable with other promotions or other coupons.

18 Mediation

If a dispute arises, any customer can send a written request to RUBBERSOLE, which will do it's best to resolve it. If the amicable settlement attempt fails, a request to a mediator must be sent within one year of the amicable claim. 19 Warranty

For the United Kingdom outside Scotland, the legal guarantee of conformity applies from the receipt of the product for a period of 6 years, within a reasonable time after the discovery of the lack of conformity.
For Scotland, the legal guarantee of conformity applies within a reasonable time after discovery of the lack of conformity and from receipt of the product for a period of 5 years.

For the whole of the United Kingdom, RUBBERSOLE must provide proof within the first 6 months of conformity, then it will be up to the customer to prove the lack of conformity for the following months.

The guarantee of conformity does not apply in case of modification on the product, in case of normal wear of the product, in case of improper use of the product, in case of non-respect of the rules of maintenance of the product and for damage caused by transportation or storage of the product.

The replacement or repair of the product will be free of charge within a reasonable time unless it is disproportionate to the damage or if this is not possible. In case of impossibility, RUBBERSOLE will, at no cost, make a partial or total refund, as the case may be.

20 Rubbersole Premium

RUBBERSOLE.CO.UK also offers a subscription service called Rubbersole Premium.

Rubbersole Premium is a subscribed service for a period of 12 months which is purchased at registration. If the customer wishes to continue to enjoy the benefits of this subscription after 12 months, they may renew the subscription by ordering the service on the website for an additional 12 months.

The benefits of the Rubbersole Premium are:

- 10% immediate discount on full price items.
- 5% extra discount on sale items during the Summer and Winter sale periods.
- Exclusive offers : additional discounts reserved for Premium customers.

Discount conditions:
